![]() Life under a burden of debt is not much fun. Constant harassment by phone, threats of repossession and calls at work from rude creditors can really wear a person down. When confronted with overwhelming debt people try many things. They try to borrow their way out of debt. They try debt consolidation companies. They borrow from relatives. They try everything they can think of to resolve the situation and often end up making things worse, rather than better. Bankruptcy is not for everybody, but it is there if you need it. Our firm offers a free consultation and will give you your options, bankruptcy and otherwise. It will then be up to you to decide what to do. Many times all a person needs is a month or two to get organized and set up a payment plan to pay the debts he owes. About 60% of our clients file a case under Chapter 13 where a client's creditors are paid through a plan set up under the protection of the bankruptcy court. In this type of plan most people are able to keep the house, cars and personal property pledged as collateral and pay what they can afford to pay over a 3 to 5 year period. In a Chapter 13 case even difficult creditors such as the IRS and ex-spouses owed back child support can be controlled. Many of our clients genuinely want to pay their creditors and save their property and a Chapter 13 allows them to do so in a manner in which they can afford. Other clients are simply unable to pay any more and need to file a case under chapter 7 where debts are discharged and eliminated. Even in this type of bankruptcy clients are able to keep some types of property. Call for a free consultation and we will explain how this works.
